These Terms and Conditions (“Terms”) constitute a legally binding agreement (“Agreement”) between you and Wee Derry Shot. By placing an order, you are offering to purchase a product on and subject to the following Terms.

All orders are subject to availability and confirmation of the order price.

We reserve the right to change or update our terms, including those relating to the online use of Shop at any time and without notice.

When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.

By using this Website, you warrant that all data provided by you is accurate and up to date. You are responsible for maintaining and promptly updating account information for accuracy and completeness.

How the Contract is Formed

After placing an order, you will receive an email from Wee Derry Shot acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer made by you to buy a product or service from us.

The Contract will only be accepted and formed when the goods have been delivered to you.

  1. Pricing

Please note that prices shown on the website are subject to change until the contract has been formed. The prices shown are guide prices, with the final cost of your order to be determined on the day your products are picked for delivery.
The prices on the Website include VAT but exclude delivery costs, which you will be shown at the time you place your order and will be added to the total amount due.
You may pay using Visa, MasterCard credit/debit cards, or Maestro card. Your credit/debit card payment will be made through a secure Website. Card payments are subject to validation checks and authorisation by your card issuer. If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery, and may not be able to form a Contract with you or we will not be able to proceed with your order.
Wee Derry Shot must receive full payment for the order at the time the order is processed and before the product is dispatched.
The Website may contain inaccuracies, typographical errors or other errors and may not always be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fulfil any orders that you may place based on information on the Website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

  1. Stock Availability & Stock Substitution

All orders for products are subject to availability.
You will not be charged for an item which is out of stock, or which has not been delivered to you. If an item is out of stock, we may either remove it from your order or substitute that item for an appropriate similar item.
Any items which have been added to your order as a substitute for an unavailable product will be brought to your attention at the time of delivery and you may hand the item back to the delivery driver if you do not wish to purchase it. The item will then be removed from your order and the price will be refunded to the card you used to make your purchase.
Stock substitution is optional and you may opt-out before placing your order.

  1. Withdrawal of Products & Refusal of Order

Wee Derry Shot reserves the right to withdraw any products from this Website at any time and / or remove or edit any materials or content on this Website.
Whilst we will use our reasonable endeavours to authorise payments submitted to us, there may be exceptional circumstances which mean that we may need to refuse to process or accept an order after we have received it or sent you an acknowledgement of receipt, which we reserve the right to do at any time, at our sole discretion.

  1. Online Returns & Cancellations

You may change or cancel your order at any time before the cut-off time indicated on the website.
You have a statutory right to cancel your contract with us (whether in full or in respect of an individual item or items) at any time, for any reason, until the expiry of the 14th day after the day of delivery.
This does not extend to goods which are liable to expire or deteriorate rapidly, or goods which have been unsealed and are unsuitable for return for health protection and hygiene reasons. If you wish to return a perishable product, you may do so only at the time of delivery.
In order to exercise this right, please inform us by filling out this form and returning it to us, or contact us. On the exercise of this right, we will communicate to you an acknowledgement of receipt of your cancellation and we will outline further steps for you to take. Please note that we may withhold reimbursement until we have received the goods back, or until you supply evidence that you have sent the goods back.
You will be responsible for any extra cost incurred or risk in returning products. You are obliged to take reasonable care of the products while they are in your possession and you will be responsible for any diminished value of the goods resulting from the handling of the goods beyond that necessary to establish their nature, characteristics and functioning.

Faulty/ incorrect products received

We will supply goods in accordance with your order, except as outlined in these Terms, however if you have received the wrong products from Wee Derry Shot or the products are faulty or damaged in any way please contact our Customer Service team.
Please check all products at the time of delivery and hand any mistaken or faulty products back to the delivery driver to be removed from your order. If you discover a fault after delivery, please contact our Customer Service team as soon as possible.

  1. Your Order Delivery

For the purpose of these Terms, “delivery” or “delivered” shall be deemed to have occurred upon delivery of the product(s) at the address specified by you when you completed your order, after the goods have been received and signed by you or on your behalf.
One delivery charge applies for your online order, regardless of how many products you purchase. If you wish to send products to different addresses you must create a different order for each delivery address.
Delivery costs are variable. You will be informed of the final cost of delivery when placing your order.
We will contact you via email on the day of delivery to inform you that your goods have been dispatched.
If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the products may be retained by the driver. In this case, you will need to contact Customer Service to re-arrange delivery.

  1. Risk & Title

Any products ordered will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.

  1. Disclaimer of Liability

Due to the nature of this Website and the potential for errors in the storage and transmission of digital information, we do not warrant the accuracy and security of information transmitted to or obtained from this Website unless otherwise expressly set out on this Website.
All product descriptions, information and materials posted on this Website are provided “as is” and without warranties express, implied or otherwise howsoever arising.
We warrant to you that any product purchased from us through this Website is of satisfactory quality and reasonably fit for all of the purposes for which products of the kind are commonly supplied. To the fullest extent permissible pursuant to law, but without excluding anything that may not lawfully be excluded in the case of consumers, we disclaim all other warranties of any kind, whether express or implied, in relation to the products.
Our liability in connection with any product purchased through our Website is strictly limited to the purchase price of that product. Nothing in this Clause will affect your statutory rights as a consumer or your Contract cancellation rights.

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms. Any waiver of any provision of the Terms will be effective only if in writing and signed by a Director of Wee Derry Shot.

If any of these Terms or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
